The Services are operated by FindDesign. FindDesign are registered in England and Wales under company number 10338237.
2. Access to the Services
The Site, domain name and all other websites and domain names affiliated with FindDesign, and any other linked pages, features, content, or application services offered from time to time by FindDesign are owned and operated by FindDesign. Subject at all times to the Customer Terms, FindDesign may offer to provide certain services, as described more fully on the Site, which are selected by you through the process provided on the Site, together with the Services, solely for your own use, and not for the use or benefit of any third party.
Access to the Site is permitted on a temporary basis, and FindDesign reserve the right to change, suspend or discontinue Services provided through the Site without any notice. We will not be liable if for any reason any of the Services are unavailable at any time for any period.
FindDesign does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register for the Services. If you are under 18, please do not attempt to register for the Services or send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of 18 may provide any personal information to FindDesign or make use of the Services. In the event that we learn that we have collected personal information from a person under age 18 without verification of parental consent, we will delete that information as quickly as possible. You understand that FindDesign cannot guarantee the identity of any other users with whom you may interact in the course of using the Services. Additionally, FindDesign cannot guarantee the authenticity of any data which users may provide about themselves. You acknowledge that all Content accessed by you using the Services is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom.
Uploaded material must not: (i) be defamatory of any person; (ii) contain material which is obscene, discriminatory, offensive, hateful, threatening or inflammatory; (iii) infringe any copyright, database right or trade mark of any other person; (iv) be likely to deceive any person; (v) promote any illegal activity; (vi) be likely to harass, upset, embarrass, alarm or annoy any other person; or (vii) be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
Under no circumstances will FindDesign be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred in connection with use of or exposure to any Content posted, emailed, accessed, transmitted, or otherwise made available via the Services. FindDesign have the right to remove any material or posting a user makes on the Site.
4. Disclaimer of Warranties and Limitation of Liability
FindDesign has no special relationship with or fiduciary duty to you. You acknowledge that FindDesign has no control over, and no duty to take any action regarding: which users gains access to the Services; what Content you access via the Services; what effect the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of having been exposed to the Content.

The Site and Services are provided “as is” and “as available” and we expressly disclaim to the fullest extent permitted by law all express, implied and statutory warranties.
Nothing in these Customer Terms shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.
5. Viruses, Hacking and Other Offences
You must not misuse our Site or any part of the Service by introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. 7. How Contracts are Formed Between you and Sellers

You acknowledge that these Customer Terms, and/or any transaction made by you via finddesign.com, does not create or imply any partnership, joint venture or trust relationship between us, you and/or any Seller. All prices shall be shown in the applicable currency and payable in that currency. You accept that some banks may charge you an additional fee for certain transactions (for example, international transactions). You accept that item prices in the currencies displayed on the Site do not vary according to your location; delivery charges will vary depending on the destination you choose to have the item delivered to. For delivery destinations within the EU prices include VAT or other sales taxes where applicable. For delivery destinations outside the EU, prices do not include VAT or other sales taxes.
Payment for finddesign.com products are processed through our secure online payment service, managed by Stripe and secured by their privacy and security policies, which can be found at https://stripe.com/gb/privacy.
By using the Site, you also agree to be bound by Stripe’s Terms of Service.
9. Refusal of Transactions
We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.
Delivery details are displayed on the product page on the Site. The delivery costs for each Seller vary according to the delivery methods they offer. Any delivery times quoted are in working days.
11. Import Regulations & Duties
If you order goods from our Site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict or advise on their amount. Please contact your local customs office for further information before placing your order.

Any returns or refunds shall be made by the Seller in accordance with the Returns Policy.
You are responsible for all of your activity in connection with the Services. A waiver of any right or remedy under any agreement to which these Customer Terms apply is only effective if given in writing and shall not be deemed a waiver of any subsequent breach or default. No failure or delay by a party to exercise any right or remedy provided under any agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
If any of these Customer Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
17. Entire Agreement
These Customer Terms and any documents expressly referred to in them constitute the entire agreement between us and supersedes and extinguishes all previous drafts, agreements, arrangements and understandings between us, whether written or oral, relating to its subject matter. Each of us agrees that neither we nor you shall have any remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in these Customer Terms or any documents expressly referred to in them. Neither of us shall have any claim for innocent or negligent misrepresentation based upon any statement in these Customer Terms and any documents expressly referred to in them.
18. Force majeure
Neither FindDesign or any Seller shall be liable for any delay or failure in performing its obligations under any agreement to the extent that such delay or failure is caused by an event or circumstance that is beyond the reasonable control of that party, and which by its nature could not have been foreseen by such party. If any events or circumstances prevent either party from carrying out its obligations under an agreement, performance of its obligations shall be postponed for the period of time that the circumstances continue.
19. Rights of Third Parties
No provision of these Customer Terms shall be enforceable by any third party under the Contracts (Rights of Third Parties) Act 1999 or otherwise. For the avoidance of doubt, nothing in this clause excludes the rights of FindDesign when acting as commercial agent of any Seller.
20. Law and jurisdiction
Contracts for the purchase of goods or services through the Site or via the Services shall be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England.
This Agreement shall remain in full force and effect while you use the Services. You may terminate your use of the Services or your registration on the Site at any time by following the instructions on the Site. FindDesign may terminate your access to the Services or your registration on the Site, at any time, for any reason, and without warning, which may result in the forfeiture and destruction of all information associated with your registration. FindDesign may also terminate or suspend any and all Services and access to the Site immediately, without prior notice or liability, if you breach any of the terms or conditions of these Customer Terms. Any fees paid hereunder are non-refundable. Upon termination of your right to use the Services, and/or access the Site, any Content will immediately cease. All provisions of these Customer Terms which, by their nature, should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
